Forex trading is legal in India only through permitted channels. Indian residents can trade currency derivatives on SEBI-recognised exchanges (NSE, BSE, MSE) through a SEBI-registered broker. These contracts cover INR pairs such as USD-INR, EUR-INR, GBP-INR and JPY-INR, plus the exchange-traded cross-currency contracts EUR-USD, GBP-USD and USD-JPY. Trading forex or CFDs with offshore online platforms is a different matter. The RBI says remittances for margin to overseas counterparties are not allowed under the Liberalised Remittance Scheme. Its public Alert List names many large international brokers, including Exness, HFM, Vantage, JustMarkets, PU Prime, FBS, XM, IC Markets and Pepperstone.
The Two Routes, Side by Side
| Permitted route | Offshore route | |
|---|---|---|
| Where you trade | NSE / BSE / MSE currency derivatives | Overseas broker's MT4/MT5/app |
| Instruments | INR pairs; EUR-USD, GBP-USD, USD-JPY cross contracts | Any FX/CFD the broker lists |
| Regulator | SEBI (exchange) + RBI framework | Foreign regulator only, often offshore |
| Funding | Indian bank account to SEBI broker | Remittance abroad, which the RBI says LRS doesn't allow for margin |
| RBI status | Authorised | Many brands named on the RBI Alert List |

What the RBI Alert List Says
The RBI describes its Alert List as entities that are "neither authorised to deal in forex under FEMA nor authorised to operate electronic trading platforms (ETPs) for forex transactions", along with sites that promote them. When we checked on 2026-10-01, it had 95 entries, including:
- Brokers: Exness, HotForex and HF Markets (HFM), Vantage Markets, Just Markets, PU Prime, FBS, XM, IC Markets, Pepperstone, FP Markets, Tickmill, AvaTrade, Admiral Markets, Easy Markets, OctaFX, FXTM, IG Markets, eToro, Forex.com, ThinkMarkets, Fusion Markets.
- Prop firms: FTMO and FundedNext.
- Platform websites: metatrader4.com and metatrader5.com.
The RBI also says the list is not exhaustive. A platform that isn't on it should not be assumed to be authorised. Authorisation can be checked against the RBI's lists of authorised persons and authorised ETPs.
Why "It's Regulated Abroad" Doesn't Settle It
An offshore broker can hold a real licence in Seychelles, Mauritius, Cyprus or South Africa. That licence covers the broker's own jurisdiction. It doesn't make the platform an authorised ETP for Indian residents under FEMA. The RBI's LRS rules also state that remittances for margin or margin calls to overseas exchanges and counterparties are not allowed. Indian banks and payment providers have blocked or reversed card and UPI payments to these platforms for that reason.
Several of these brokers also say they don't serve India. JustMarkets, for example, lists India among its restricted jurisdictions.
Practical Risks for Indian Traders
- No Indian recourse: SEBI and RBI complaint channels don't cover offshore platforms.
- Payment risk: deposits may be blocked, and withdrawals can be held up by banking checks.
- Clone and "account manager" scams: names on the Alert List are often copied by Telegram and WhatsApp groups offering guaranteed returns.
- Tax and reporting: income from unpermitted transactions can still create reporting and penalty exposure. Get advice from a qualified Indian tax professional.
How to Trade Currencies Legally
- Open a trading account with a SEBI-registered stockbroker that offers the currency derivatives segment.
- Trade the exchange-listed currency futures and options on NSE, BSE or MSE.
- Check the broker's SEBI registration number on sebi.gov.in before funding.
Check Before You Fund Anything
Search the platform name on the RBI Alert List (rbi.org.in, under "Alert List"), and check RBI's list of authorised ETPs. If you already hold an offshore account, keep your statements and deposit records, and get professional advice before moving more money.
