Forex and CFD trading is legal in Australia through a broker holding an Australian Financial Services Licence (AFSL) from ASIC. For retail clients, ASIC's CFD product intervention order caps leverage at 30:1 on major currency pairs. Lower caps apply to minors, gold and indices (20:1), other commodities (10:1), shares (5:1) and crypto (2:1). The order also requires negative balance protection and margin close-out at 50%. ASIC extended the order to May 2027. Before opening an account, check the broker's AFSL on ASIC's Professional Register. Make sure your account will be held by the Australian entity, not an offshore sister company.

How to Check an AFSL
- Search the broker's legal name on ASIC Connect's Professional Register.
- Confirm the licence is current and authorises dealing in derivatives and foreign exchange for retail clients.
- Make sure the name on your account application matches that entity.
- Check ASIC's MoneySmart investor alert list for clones.
Offshore Accounts and "Wholesale" Status
Some brokers offer Australians higher leverage by moving them to an offshore entity or by classifying them as wholesale clients. Either way you lose the retail protections above. Only accept this if you understand the trade-off.
